B.2 政信政策法律研究报告

摘要：我国法治政府建设在取得重大成就的同时，仍然存在政府信用缺失的问题，而其中一个重要原因就是相关法律制度不完善。因此，有必要加强政信法律制度建设，通过法律手段对政府失信行为进行规制。本报告从依法行政、信赖保护原则、政府信息公开等方面对我国政信法律制度现状进行分析，指出存在政信相关法律体系不健全、行政职权界限不明、政信法律表述不清等问题，同时结合我国具体国情，提出完善我国政信相关法律制度的建议。本报告主张通过推动行政程序立法、完善行政公开立法、健全行政职权立法、健全政府失信惩戒制度、建立政务诚信评估机制、完善公务员制度、加强政府信用监督几个方面完善我国政信相关法律制度。

Abstract：While the construction of law-based government in China has made great achievements, there is still a problem of lack of governmental credit, and an important reason is that the legal system of governmental credit is not perfect. Therefore, it is necessary to strengthen the construction of the governmental credit legal system and regulate the government's dishonesty through legal means. This paper analyzes the status quo of China's governmental credit legal system from the aspects of administration by law, principle of trust protection, disclosure of government information, etc.. It also points out that there are problems in China's current governmental credit legal system such as the imperfect governmental credit legal system, the unclear boundaries of administrative powers, and the unclear legal expression of governmental credit. Combined with China's specific national conditions, it puts forward suggestions on perfecting the governmental credit legal system. This paper advocates that China should improve the governmental credit legal system by promoting administrative procedures legislation, improving administrative open legislation, improving administrative power legislation, improving government disciplinary punishment system, establishing governmental credit evaluation mechanism, improving the civil service system, and strengthening governmental credit supervision.
